Terms of Service

These Terms of Service ("Terms") govern your use of whitecloudflutes.com and your purchases from White Cloud Flutes ("we," "us," or "our"). By using our site or placing an order, you agree to these Terms. Please read them — we've kept them plain and fair.

Who we are

White Cloud Flutes is an independent instrument workshop in San Francisco, California, USA. You can reach us anytime through our contact page.

Eligibility

You must be able to form a binding contract to buy from us. If you're using the site on behalf of someone else, you confirm you're authorized to do so.

Our flutes

Our flutes are 3D-printed from plant-based PLA, reproducing a design that's been tuned to true pitch — so every flute plays with the same consistent tuning. Minor variations in finish, color, or texture between prints are normal and are not defects. Product photos are representative of the model you'll receive.

Prices and availability

Prices and availability can change at any time, and despite our best efforts an occasional error can occur. If an item's price or description is clearly wrong, we may correct it, or cancel and refund the affected order. All prices are in US dollars.

Orders

Your order is an offer to buy. We may accept or decline any order — for example, if an item is unavailable or an error is found. An order confirmation acknowledges your order; a contract is formed when we ship it.

Payment

Payments are processed securely by Square. By placing an order you authorize the total shown at checkout, including any taxes and shipping, and you confirm you're authorized to use the payment method.

Shipping, returns, and cancellations

Our Shipping Policy and Returns & Exchanges policy are part of these Terms. To change or cancel an order, reach out as soon as you can and we'll help if it hasn't shipped yet. Custom and made-to-order flutes may not be cancellable once we've begun work.

Intellectual property

Our designs, logos, images, text, and other content on this site are owned by White Cloud Flutes and protected by law. You may not copy, reproduce, or use them commercially without our written permission. The flute you buy, of course, is yours — play it, record with it, perform with it, and teach with it freely.

Reviews and submissions

If you post a review or other content, you confirm it's your own and grant us a non-exclusive, royalty-free license to use and display it in connection with our store. Please keep it lawful and respectful; we may remove content that isn't.

Acceptable use

Please don't misuse the site — no attempting to breach security, disrupt the service, scrape it at scale, or use it for unlawful purposes.

Disclaimers

The site and products are provided "as is" and "as available." As with any acoustic instrument, please play and handle your flute sensibly and keep it out of extreme heat. To the fullest extent permitted by law, we disclaim implied warranties not expressly stated here. Nothing in these Terms limits rights you have under the mandatory consumer law of your country.

Limitation of liability

To the fullest extent permitted by law, White Cloud Flutes will not be liable for indirect, incidental, or consequential damages, and our total liability for any order is limited to the amount you paid for it.

Indemnification

You agree to hold White Cloud Flutes harmless from claims arising out of your misuse of the site or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules, and the courts located in California will have jurisdiction — except where the mandatory law of your country of residence provides otherwise.

Changes

We may update these Terms from time to time. The version posted here, with the date below, is the one that applies.

Severability

If any part of these Terms is found unenforceable, the rest remains in effect.
